Phasing out age exemption: what the 2008 law says
Before the reform, the mechanism was simple. A job seeker aged 55 or older could be exempted from any active job search while continuing to receive their allowance, whether it was the ARE or the specific solidarity allowance (ASS). Survivor regime for previous beneficiaries
Individuals who obtained their exemption before this date retain their rights, provided they have remained continuously indemnified and still meet the initial criteria. This survivor regime concerns a number of beneficiaries that decreases mechanically each year as these recipients reach retirement age.

Duration of indemnification and maintenance of rights to ARE
The issue of exemption is often linked to that of the duration of indemnification. Seniors benefit from longer indemnification periods than other age groups, which can create confusion with the idea of exemption. Receiving ARE for a longer time does not mean being exempt from seeking a job.
ARE ceases when the job seeker can claim their full pension rights. France Travail regularly checks the situation of beneficiaries approaching the legal age. A senior who meets the conditions for full rate without having claimed their pension may see their allowance suspended.
What the removal of the exemption has changed for unemployed seniors
Seniors exempt from job search were no longer counted as unemployed, even though they needed supplementary income and their professional experience could be useful to the labor market.
The removal of the system has had the effect of reintegrating these profiles into the statistics and monitoring. The employment rate of seniors has increased since 2012, although the causes are multiple (raising the legal retirement age, successive pension reforms, labor market pressures in certain sectors).
